TwinTalk Terms of Use
These terms govern the use of TwinTalk. They supplement the Privacy Policy and in particular clarify responsibilities relating to private communications between users.

1. Purpose of TwinTalk
TwinTalk is a private communication service that enables, among other things, the exchange of messages and media, translation features and, depending on available features, audio or video calls.
TwinTalk provides the technical communication tool. Bouba is not the author of content created or sent by users.
2. Account and security
The user is responsible for the accuracy of the information they provide, the security of their device and the confidentiality of their credentials.
The user must never disclose their password, private keys, recovery codes or other security secrets to a third party, including in a report sent to support.
3. User responsibility for content
Each user is responsible for the messages, images, videos, files, statements and other content they create, transmit or share through TwinTalk.
The user must ensure that they have the necessary rights to transmitted content and that they comply with the law, the rights of other persons and their privacy.
4. Prohibited uses
TwinTalk may not be used to commit, facilitate or encourage illegal activity or to infringe the rights of others.
- Harassment, threats, intimidation, impersonation or fraud.
- Distribution of manifestly illegal content or content transmitted without the necessary rights or permissions.
- Intentional infringement of privacy, copyright or other third-party rights.
- Attempting to compromise the security of TwinTalk, an account, a device or the service infrastructure.
- Abusive automated use, misuse of the service or behavior intended to disrupt its operation.
5. Private communications and no prior monitoring
TwinTalk is designed as a private communication tool. Bouba does not perform prior editorial monitoring of users’ private conversations.
When messages or media are protected by TwinTalk end-to-end encryption, Bouba does not hold the server-side keys required to read the content in plain text. It is therefore not technically possible to proactively inspect such content from the server.
The absence of prior monitoring does not authorize the publication or transmission of illegal content and does not prevent Bouba from acting, or being required to act, when it has sufficient information or when a competent authority requires it.
6. Reporting content, behavior or an account
A user who believes they are the victim of abusive behavior, unlawful use or problematic content may send a report to [email protected] with the subject “TwinTalk Report”.
When reported content is encrypted and inaccessible server-side, the report must provide enough information for review: the account or username concerned, approximate date, description of the facts and, if necessary, a copy, export or screenshot of the content available to the reporter.
Never attach a password, private key, recovery code or other security secret.
7. Measures that may be taken
Where a sufficiently documented report, available technical information or a legal request justifies action, Bouba may take reasonably necessary and proportionate measures: request additional details, secure an account, restrict certain features, suspend or close an account, or cooperate with a competent authority.
Bouba cannot promise remote reading, recovery or deletion of encrypted content where it does not possess the necessary keys or where the content is no longer under its technical control.
8. Third-party technical services
Some TwinTalk features rely on third-party infrastructure or technical services, for example for real-time communications, notifications, hosting or certain translations. Their unavailability may temporarily affect all or part of the service.
9. Service availability
Bouba uses reasonable means to ensure the operation and security of TwinTalk but does not guarantee permanent and uninterrupted availability. Interruptions may result, in particular, from maintenance, an update, a network failure, a security incident or a third-party service.
10. Limitation of liability
Subject to mandatory legal provisions, Bouba is not responsible for content created, chosen or sent by users or for the consequences of communications between them.
Bouba remains responsible for its own legal obligations and does not seek through these terms to exclude liability that cannot legally be excluded or limited.
11. Suspension or closure of an account
Bouba may suspend or close an account where necessary to protect the service or its users, address a serious breach of these terms, prevent manifestly abusive use or comply with a legal obligation.
Where circumstances permit, the measure applied is proportionate to the situation identified.
12. Changes to the service and terms
TwinTalk may evolve. These terms may be adapted to reflect a new feature, technical change or legal requirement. The last-updated date identifies the applicable version.
13. Applicable law
These terms are governed by Belgian law, without prejudice to mandatory consumer-protection rules from which a consumer may benefit under the law applicable to their situation.
